These Terms and Conditions (the “Terms”) govern all services provided by Spring Valley Automotive (“we,” “us,” or “our”), an NYS-certified auto repair shop located at 140 NY-59, Spring Valley, NY 10977. By requesting or authorizing any inspection, diagnosis, maintenance, or repair service, you (“you” or the “customer”) agree to be bound by these Terms.

1. Service Estimates and Authorization

1.1 We may provide written or verbal estimates for diagnosis, parts, labor, and applicable taxes before beginning work. Estimates are based on the information available at the time and are not a guarantee of final cost. If additional problems are discovered during service, we will make reasonable efforts to contact you for approval before performing additional work that increases the estimate.

1.2 Your signature on a work order, repair authorization, or acceptance of service by phone, text, email, or in person authorizes us to operate your vehicle on streets and highways as necessary for testing, inspection, and quality control.

1.3 Diagnostic fees may apply even if you choose not to proceed with recommended repairs. These fees will be disclosed to you in advance where reasonably possible.

2. Payment Terms

2.1 Payment is due in full upon completion of services and before vehicle release, unless we have agreed to alternative arrangements in writing. We accept major forms of payment as posted at our location.

2.2 If your vehicle is covered by a third-party warranty, insurance policy, or service contract, you remain responsible for any charges not covered or not paid by the third party, including deductibles, denied claims, or delays in payment.

2.3 We may charge storage fees for vehicles left on our premises more than three (3) calendar days after you have been notified that repairs are complete, at a reasonable daily rate posted at our shop.

3. Liability Limitations

3.1 We will handle your vehicle with care and perform services in a professional manner consistent with our NYS-certified standards. However, our liability is limited to the cost of the services performed and parts supplied by us. To the fullest extent permitted by law, we are not responsible for indirect, incidental, consequential, or special damages, including but not limited to loss of use, lost time, inconvenience, or loss of income.

3.2 We are not responsible for pre-existing conditions, normal wear and tear, or damage resulting from misuse, neglect, lack of maintenance, modifications, accidents, or work performed by other shops or individuals.

3.3 Any claim related to damage allegedly occurring on our premises must be reported to us in writing before the vehicle leaves our property after the relevant service visit. Once the vehicle has departed, it is presumed to have been accepted in satisfactory condition regarding visible exterior and interior damage.

4. Warranty on Parts and Labor

4.1 We stand behind the quality of our work. Unless otherwise stated on your invoice, we may offer a limited warranty on certain parts and labor from the date of service, subject to the specific terms provided to you at the time of repair. Warranty terms can vary depending on the part, manufacturer, and type of service performed.

4.2 Our warranty does not cover normal wear items (such as brake pads, tires, wiper blades, and fluids), maintenance services, or issues arising from abuse, neglect, lack of recommended maintenance, modifications, or repairs performed by others after our service.

4.3 Warranty service must be performed at Spring Valley Automotive unless we authorize otherwise in writing. You are responsible for returning the vehicle to our location for inspection and any covered warranty work.

4.4 Any warranty is void if the odometer has been tampered with, if recommended repairs were declined and such declinations contributed to the failure, or if the vehicle is used in a manner inconsistent with normal consumer use (including racing or commercial overloading).

5. Vehicle Drop-Off and Pick-Up Policies

5.1 When dropping off your vehicle, you agree to provide accurate contact information and a clear description of the concerns or requested services. For after-hours drop-off, you are responsible for securing the vehicle and keys in the manner we have designated.

5.2 We will make reasonable efforts to contact you when your vehicle is ready for pickup. You agree to pick up your vehicle promptly after notification and to pay all charges due at that time.

5.3 For your protection, we may require valid identification before releasing a vehicle. We will only release the vehicle to you or to a person you have clearly authorized.

6. Abandoned Vehicle Policy

6.1 A vehicle may be considered abandoned if it remains on our premises more than thirty (30) calendar days after we have notified you that repairs are complete or that we are unable to contact you for authorization, and you have not made payment arrangements or otherwise communicated with us to pick up the vehicle.

6.2 We reserve all rights and remedies available under New York law with respect to abandoned vehicles, including but not limited to asserting a mechanic’s lien, charging reasonable storage fees, and arranging for the sale or disposal of the vehicle to recover unpaid charges, storage, and related costs.

6.3 You will remain responsible for any deficiency between the amount owed and any proceeds recovered from a sale or disposal, as permitted by law.

7. Customer Property Responsibility

7.1 Please remove or secure any personal items from your vehicle before service. We are not responsible for loss or damage to personal property left in the vehicle, including but not limited to electronics, tools, valuables, documents, or child seats, except where caused by our gross negligence or willful misconduct as determined in accordance with applicable law.

7.2 Any parts that are replaced during service may be discarded by us unless you specifically request in advance that they be saved for your inspection at the time of pickup, and such retention is allowed by law and by the part manufacturer or supplier.

8. Dispute Resolution

8.1 We are committed to resolving concerns in a fair and professional manner. If you have a question or dispute about our services or charges, please contact us as soon as possible so we can review your concerns and attempt to resolve the matter directly.

8.2 These Terms, and any dispute arising out of or relating to our services, will be governed by the laws of the State of New York, without regard to its conflict of law rules. Any legal action must be brought in the state courts located in Rockland County, New York, unless otherwise required by law.

8.3 To the extent permitted by law, you and Spring Valley Automotive agree to first attempt to resolve disputes informally. If a dispute cannot be resolved informally, you and we agree to pursue resolution in accordance with applicable New York law and any consumer protection procedures that apply.
